Denmark

European Union's WEEE Directive 2002/96/EC on Waste of Electronic and Electrical Equipment requires that, the WEEE symbol must be placed on an EEE product if the product falls in one of the 10 categories and is placed onto the EU market after the 13th August 2005. Producers must provide refurbishment, treatment and reuse information for each "new" WEEE. The directive obligates member states to establish and maintain a registry of producers putting electrical and electronic equipment onto the market. So far, there does not exist a centralized European registration office. Producers must register in individual member states of the EEA.

In Denmark, WEEE-System is responsible for administering the rules on producer responsibility.

Timing of implementation:

Producer responsibility takes effect as from 1 April 2006. However, producers and importers must register with WEEE-System no later than 1 January 2006, or no later than 14 days before EEE products are placed on the market.

National legislation:

Act no. 385 on producer liability for electronic waste, amending the Environmental Protection Act (entered into force on 1 June 2005)

Statutory Order 664 concerning the management of waste electrical and electronic equipment of 27 June 2005.

Producer Responsibility:

Producer responsibility applies to all producers and importers marketing EEE within specified product categories in Denmark, including undertakings in other EU Member States selling their products through distance contracts or by internet trade directly to households in Denmark.
Producer responsibility means that producers and importers of EEE must:

register in the WEEE-System Producer Register, giving detailed information on product categories and labels.

collect WEEE from private households at the municipal recycling stations in accordance with instructions given by WEEE-System.

collect WEEE from trade and industry at their customers, or make an agreement with their customers on transfer of the producer responsibility.

make sure that the WEEE that is collected undergoes special treatment at a treatment facility.

inform treatment facilities about reuse and treatment of the products.

pay all costs of transport and treatment of WEEE.

provide security for future costs for transport and management of WEEE from private households.

report data on volumes to WEEE-System regarding marketed products and WEEE that has been collected.

assume collective responsibility for WEEE from private households that was marketed before 1 April 2006 (”historical waste”).

Producers and importers may decide to discharge their functions individually or by joining a collective scheme.
